Overview
A downtown mixed-use development had been frozen for two years by a zoning appeal and a clouded title on one of its parcels.
The matter
Form had assembled four parcels for a mixed-use tower, but a neighbor's appeal of the rezoning and an unresolved easement on one parcel had stalled financing for two full years.
Our strategy
We negotiated a settlement with the appealing neighbor, quieted title through a declaratory action, and restructured the parcel agreements so the lender's conditions could finally be satisfied.
The result
Entitlements were secured, title was cleared, and the project closed its construction loan. Ground broke the following spring on a 220-unit development.
