Overview

A larger rival accused our client of infringing three diagnostic patents and sought an injunction that would have pulled its lead product from the market.

The matter

Atlas had spent ten years and its Series B developing a diagnostic assay. Weeks before launch, a competitor filed suit on three patents and moved for a preliminary injunction that would have frozen the product on the eve of its release.

Our strategy

We attacked validity and non-infringement in parallel, retained the field's leading expert before opposing counsel could, and reframed the case around prior art the rival had failed to disclose to the patent office.

The result

The court denied the injunction and, after a two-week trial, found no infringement and held the rival's lead patent invalid — clearing the field for our client's launch.
